At Kimchi Burrito™ Sunglasses, we’re all about sparking clarity and bold action through our stylish eyewear. Welcome to getkimchiburrito.com (the “Site”), where our classic square-frame sunglasses, and soon aviators and blue light lenses, light your path. These Terms of Service (“Terms”) govern your use of our Site and purchases of Kimchi Burrito™ Sunglasses (“Products”). By accessing the Site or buying Products, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Site or purchase Products. Questions? 1. Eligibility

You must be at least 18 years old to use the Site or purchase Products. By using the Site, you confirm you have the legal capacity to enter a binding contract.

2. Products and Orders

  • Descriptions: We strive to accurately showcase Kimchi Burrito™ Sunglasses (e.g., matte black BLK-01, light blue LTB-01), but monitor displays may vary slightly in color or detail.
  • Pricing: Prices are in USD, subject to change, and exclude taxes (e.g., sales tax, VAT).
  • Order Acceptance: Orders aren’t final until we send a shipping confirmation email. We may refuse or cancel orders due to availability, errors in pricing or description, or suspected fraud.
  • Payment: We accept payments via WooCommerce and PayPal. You agree to provide accurate billing information, authorizing us to charge for orders, taxes, and shipping fees.
  • Availability: Products are subject to availability. We may limit quantities, fulfill partial orders, or discontinue Products without notice.

3. Shipping and Delivery

  • Policy: We ship to your provided address via USPS within 2 business days of order confirmation.
  • Timelines: Delivery dates are estimates, not guaranteed. We’re not liable for shipping delays.
  • Risk of Loss: Risk transfers to you upon delivery to the carrier. We’re not responsible for lost or stolen packages confirmed delivered.
  • International Shipping: Not currently offered, but we’re working on it.

4. Returns, Refunds, and Exchanges

  • Policy: We accept returns for defective or shipping-damaged Products within 30 days of delivery, offering free replacements (same or comparable style, based on availability) or refunds if replacements aren’t available (US only). Non-defective items, discounted, limited edition, custom orders, or gift cards are non-returnable.
  • Process: Email info@getkimchiburrito.com with your order number and defect photos within 7 days of receipt. We’ll provide a prepaid US shipping label and process replacements or refunds within 5–7 business days.
  • Conditions: Products must be unused, in original packaging with tags. Customers cover international return shipping unless we made an error.

5. Intellectual Property

  • All Site content (text, logos, images, designs) and Kimchi Burrito™ trademarks are owned by Kimchi Burrito™ Sunglasses, protected by US and international copyright and trademark laws.
  • You’re granted a limited, non-commercial license to use the Site for personal purposes, not for resale or unauthorized use of our trademarks.

6. Site Usage

You agree to use the Site lawfully and not to:

  • Violate any laws or regulations.
  • Disrupt others’ use of the Site or harm Kimchi Burrito™ Sunglasses.

Kimchi Burrito™ Sunglasses, its affiliates, or agents aren’t liable for indirect, incidental, or consequential damages from Site or Product use. Our total liability is limited to the amount you paid for the Product(s) in the three (3) months before the claim. Some jurisdictions may not allow these limitations.

12. Indemnification

You agree to indemnify Kimchi Burrito™ Sunglasses against claims arising from your Site use, violation of Terms, or infringement of third-party rights.

13. Governing Law

These Terms are governed by Mississippi law. Disputes will be resolved in Tishomingo County, Mississippi courts.

We may update these Terms, providing 30 days’ notice for material changes via the Site or email. Continued use after changes means you accept them.

15. Severability

If any Term is unenforceable, it will be modified or severed, with remaining Terms intact.

16. Entire Agreement
